1. Terms and Conditions
a) This website is owned and operated by Work-Boss and is made available on the following Terms and Conditions. If you do not accept the Terms and Conditions stated here, do not use this website and service. By using the website you accept these Terms and Conditions, which shall be governed and construed in all respects in accordance with the Laws of Queensland and the parties hereby submit to the exclusive jurisdiction of the Australian Courts.
b) As part of the terms and conditions of the website, all users must read and agree to the following terms and conditions, every time this site is accessed.
c) These Terms and Conditions shall take immediate effect in substitution for all previous Terms and Conditions relating to the services whether written, oral or implied between Work-Boss and our customers.
d) Work-boss may at any time and without notice revise any term or condition, and will be effective immediately.
e) Work-Boss at all times has final say, to all aspects of this site and may without notice make any changes it so chooses.
f) Work-boss has the right to change or discontinue any feature of the website without notice.
g) Any material placed on this site can be archived by work-boss, indefinitely as a condition of use.
h) You acknowledge and agree that you are solely responsible for the form, content and accuracy of any details, resume, contract, tender, ads or material contained therein placed by you on the website. Employers or representatives are solely responsible for their postings of jobs on the website. and any third party/representative posting worker details on this website, are responsible for such material.
i) All users using this website do so at the pleasure of work-boss, as such all users are responsible for their actions & the consequences of these actions, as a condition of use without exception.
j) Work-boss reserves the right to information & material held, which it considers to be of business use / purpose or value, including all statistical information etc from this site.
k) Users performing transactions on this site are of legal age & authority to perform such act.
l) Work-boss views all transactions as having been made by a legally authorised individual.
m) Any person having their details displayed on this site in the worker section, and having found a job, or any person having placed an ad/contract/tender on this site, and having it forfilled, must within 48 hours, remove said material from public view.
n)1 work-boss reserves the right, to editing any entry in it's database, to comply with the website's designed function, without notice to the individual involved; as guidelines to completing the relevant forms are clearly displayed, on such pages; breaching these will result in editing of this material, whether the person is of paid or free status, any reinclusion of edited material or like will result in immediate deletion from the database; with any or all transaction costs by the individual, forfeited in this situation; this decision is final.
n)2 Work-boss reserves the right, to edit or remove, without notice, any material from it's site which, it considers, infringes it's intended use, function or perception of the site, such editing or removal is non refundable & final, all material on this site must be of, or relate to employment, (the word employment shall be defined by work-boss and not used in situations to circumvent the nature of this site).

p) Work-Boss may, at its discretion and without notice, report improper or illegal use of Resumes or the Services by our users to the relevant legal and/or professional bodies. It is the responsibility of the Employer to ensure they comply with the Human Rights and Equal Opportunity Commission Act 1986 and all other anti-discrimination legislation applicable in the state in which they conduct business.
2. Intellectual Property
Work-Boss authorises you to view and download relevant material on the website.
The content of this website, such as text, graphics, images, logos, button icons and software, the "Material", are protected by the law of copyright and trademarks. All Material is the property of Work-Boss or its content suppliers, or clients. The compilation (meaning the collection, arrangement and assembly) of all content on this website is the exclusive property of Work-Boss and protected by Australian and international copyright laws. Unauthorized use of the Material may violate copyright, trademark and other laws. You must retain all copyright, trademark, service-mark and other proprietary notices contained in the original Material on any copy you make of the Material. You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. 3. Information may contain errors and inaccuracies
The databases accessible through this web site contain large quantities of information which has been entered manually and inevitably errors and inaccuracies occur in such a process.
4. Liability
Work-Boss does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.
Work-Boss acts as a passive conduct for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not confirm to these Terms and Conditions, Work-Boss will investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. Work-Boss has no liability or responsibility to users for performance or non-performance of such activities. Work-Boss reserves the right to expel users and prevent their further access to the website for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. Work-Boss may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for Work-Boss or may cause Work-Boss to lose (in whole or in part) the services of its ISPs or other suppliers.
Any removal of information made under these conditions will forfeit the cost of such material (transaction).
5. Warranty
Work-Boss disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement. Work-Boss makes not warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics and links.
6. Disclaimers
If this limitation of liability or the exclusion of warranty set forth above is held inapplicable or unenforceable for any reason, then Work-Boss's maximum liability for any type of damages shall be limited to AUD $100.00.
7. Specific Prohibited Uses
The website may be used only for lawful purposes by the public. Work-Boss specifically prohibits any use of the website, and all users agree not to use the website, for any of the following:
- Posting any incomplete, false or inaccurate
biographical information or information which is not your own
accurate Resume or Job Specification.
- Deleting any material posted by any other
person or entity.
- Using any device, software or routine to
interfere or attempt to interfere with the proper working of
this website or any activity being conducted on this site.
- Taking any action which imposes an unreasonable
or disproportionately large load on this website's infrastructure.
- If you have a password allowing access to
a non-public area of this website, disclosing to or sharing
your password with any third parties or using your password
for any unauthorized purpose.
- Notwithstanding anything to the contrary
contained herein, using or attempting to use any engine, software,
tool, agent or other device or mechanism (including without
limitation browsers, spiders, robots, avatars or intelligent
agents) to navigate or search this website other than the search
engine and search agents available from Work-Boss on this website
and other than generally available third party web browsers.
- Attempting to decipher, decompile, disassemble
or reverse engineer any of the software comprising or in any
way making up a part of the website.
- Transmission, distribution, storage or destroying
material (a) in violation of any applicable law or regulation,
(b) in a manner that will infringe the copyright, trademark,
trade secret or other intellectual property rights of others
or violate the privacy, publicity or other personal rights of
otherwise, or (c) that is defamatory, harassing, hateful, socially
ethically or otherwise objectionable, vulgar, offensive, obscene,
threatening or abusive.
- Violating or attempting to violate the security
of the website, including, without limitation, (a) accessing
data not intended for such user or logging into a server or
account which the user is not authorised to access, (b) attempting
to probe, scan or test the vulnerability of a system or network
or to breach security or authentication measures without proper
authorization, (c) attempting to interfere with service to any
user, host or network, including, without limitation, via means
of submitting a virus to the website, overloading, "flooding",
"spamming", "mailbombing" or "crashing" or (d) sending unsolicited

may result in civil or criminal liability. Work-Boss will investigate
occurrences which may involve such violations and may involve,
and co-operate with, the police in prosecuting users who are
involved in such violations.
- Not modify, copy, distribute, transmit, display,
perform, reproduce, use, publish, license, create derivative
works from, transfer or sell any information or content contained
in the System, the Work-Boss Website as a whole software, products
or services obtained from or available as part of or in conjunction
with this System.
- Not rent, lease, lend, sub-license or transfer
the System or any data residing on it or any of your rights
under this agreement to anyone else.
- Not develop or derive for commercial sale
any data in machine-readable or other form that incorporates
or uses any substantial part of the System.
- Not transfer to or store any data residing
or exchanged over the Work-Boss System in any electronic network
for use by more than one user unless you obtain prior written
permission from Work-Boss.
8. Agreement
These terms represent the entire binding agreement between us, and our respective successors and assigns, and supersede any and all prior understanding, statements or representations, whether electronic, oral or written, regarding Work-Boss, its System or the information thereon. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
9. Transactions - Terms and Conditions
All transactions are subject to these clauses;
a) any non acceptance of these terms and conditions must be made within the proceeding 24 hour period, for a refund, and/or providing no benefit has transpired within this time frame, on the service provided by this site, to the site material involved (if a transaction is for whatever reason, brought into question and is, required to refund the card holder).
b) a transaction cannot be reversed if the service is under way or has been completed, subject to section a).
c) Users performing transactions on this site are of legal age & authority to perform such act.
d) Work-boss views all transactions as having been made by a legally authorised individual.
e) Work-boss shall not be held liable for any fee/s from any financial institution, resulting from the actions of a website user.
f) All multiple user subscriptions are non-transferable and final.
g) Work-Boss serves notice to any individual, party or parties involved with, or acting on behalf of, the card holder, questioning the validity of a transaction.
1:- that a dishonour fee of $500.00 per transaction applies, on any transaction inwhich an individual, party or parties, involved with or acting on behalf of the card holder, disputes the validity of a transaction in whatever form, work-boss holds such individual, party or parties legally responsible for the card holders actions in this matter; if our records or information, supports our position, and no reversal, chargeback, refund, is required to the card holder, or if a reversal, chargeback, refund, happens to the card holder, although the service has been undertaken or forfilled,
then such individual, party or parties shall be liable for this fee, and/ or fees herein, including all additional costs or fees accumulative upon this, including the original transaction cost, in either of these situation.
2:- Response to a request from an individual, party or parties, are billable in hour blocks, or any part there of, at the rate of $150.00 per hour.
3:- Dishonour fee, and any other costs and fees are to be settled within 24 hours of such a decision, to work-boss with out exception.
4:- work-boss may waiver such costs and fees, to the individual, party or parties, if they can impose upon the card holder, a penalty, that work-boss considers in its judgment to be worthy of waiving the costs or fees, in part or whole, to which they are liable.
